The Minister of Economy and Trade of the Interim Government of National Unity, Muhammad Al-Hawij, issued a decision regarding some controls related to registration in the commercial register, which requires that the application for registration in the commercial register for Libyan citizens be accepted, that it include the name of the owner of the four-digit activity according to the national number.
The decision of the Minister of Economy and Trade was based on Law No. 23 of 2010 AD regarding commercial activity, the executive regulations for the commercial register, and Law No. 8 of 2014 AD regarding the national number.
Quadruple name registration
Resolution No. 680 of 2022 AD stipulates that the Commercial Registry Authority and all its branches and local offices, when issuing an extract from the commercial register or amending it, must have the names of the members of the board of directors and the legal representative of the company be four names according to the national number if they are Libyan nationals.
The decision indicated, in its third article, that the provisions of this decision apply to all public and private companies and public establishments that are required by law to be registered in the commercial register and whose sole or main purpose is commercial activity, in accordance with the provisions of Article 495 of the Commercial Law.
No procedures without the national number
The Minister also directed the Commercial Registry Department to review previous entries in accordance with the new decision, and not to complete any procedures for any Libyan citizen except according to the national number.
